These Terms and Conditions govern your use of the AnswerAI service and website (answerai.com.au). By creating an account or using the service, you agree to these terms. If you use AnswerAI on behalf of a business, you agree to these terms on behalf of that business.
The Service
AnswerAI provides an AI-powered virtual receptionist that answers phone calls for your business 24/7 using artificial voice technology. The service can greet callers, answer questions based on the information you provide, take messages, capture caller details and make bookings, and it records and transcribes calls so you can review them. Features vary by plan.
Accounts
You must provide accurate information when creating an account and keep it up to date. You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly if you suspect unauthorised access.
Acceptable Use
You may use the service only for lawful purposes. You must not use it to handle calls for unlawful activities, to harass or mislead callers, or in any way that breaches telecommunications, privacy or call-recording laws. We may suspend or restrict accounts that breach these terms.
Call Recording Obligations
Calls answered by the service may be recorded and transcribed. You are responsible for ensuring that your use of call recording complies with the laws that apply to you and your callers, including informing callers that calls are recorded where the law requires it.
Plans, Billing and Cancellation
AnswerAI is offered on paid subscription plans, billed in advance through our payment provider. Plan inclusions and usage limits are described at the time of purchase. We may change pricing with reasonable notice, and changes take effect from your next billing cycle. You can cancel at any time, with cancellation taking effect at the end of the current billing period. Except where the law requires otherwise, fees already paid are not refunded.
Service Availability
We work to keep AnswerAI available around the clock, but we do not guarantee uninterrupted or error-free operation. The service depends on third-party telephone networks, AI providers and hosting infrastructure, and may be affected by maintenance, outages or events beyond our control.
AI Output Disclaimer
The AI receptionist generates responses automatically and can make mistakes, including mishearing details, giving incomplete answers or recording bookings incorrectly. You are responsible for reviewing bookings, messages and other output before relying on them. The service is not suitable for emergency calls and must not be relied on to reach emergency services.
Your Content and Data
You retain ownership of the information you provide to configure the service and of your call data. You grant us the rights needed to operate the service, including processing call recordings and transcripts on your behalf. We handle personal information as described in our Privacy Policy.
Limitation of Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law or other laws that cannot be excluded. To the extent permitted by law, we are not liable for indirect or consequential loss, including lost revenue, missed calls or missed bookings, and our total liability is limited to resupplying the service or refunding the fees you paid for the period in which the issue occurred.
Termination
You may close your account at any time. We may suspend or terminate accounts for breach of these terms, non-payment or misuse of the service, and will give notice where reasonable. On termination we will make your data available for export for a reasonable period before deleting it, subject to our legal obligations.
Changes to These Terms
We may update these terms from time to time. We will give notice of significant changes, and continued use of the service after changes take effect means you accept the updated terms.
Governing Law
These terms are governed by the laws of New South Wales, Australia, and the courts of that state have non-exclusive jurisdiction over any dispute.
